INVITATION TO RFQ for the provision of Guardianship and Custodianship under the Jordanian Legal Framework Consultancy

The Norwegian Refugee Council (NRC) is an independent, humanitarian, non-profit, and non-governmental organisation providing assistance, protection and durable solutions to refugees and internally displaced persons across 40 countries worldwide. In Jordan, NRC’s programmatic activities include Shelter, Education, Information, Counselling and Legal Assistance (ICLA) and Livelihoods. NRC maintains area offices in Irbid, Mafraq and Amman, as well as in Azraq and Zaatari refugee camps and a country office in Amman.

NRC’s ICLA programming in Jordan commenced in 2013. The main areas of law the programme supports participants in are legal identity and civil documentation, legal stay, housing and land (tenancy issues in Jordan, and Syrian land rights for Syrian refugees in Jordan), and work rights.

In the area of legal identity and civil documentation, ICLA has identified some challenges in knowledge and understanding relating to the concepts/actions of guardianship and custodianship. Because guardianship and custodianship are not properly defined in the Personal Status Law, Jordanian jurisprudence and court practice is to usually refer to Sharia doctrine (Hanafi feqeh) to identify their elements and distinguish them from one another. ‘Guardianship’ is mainly the ability to legally represent another person who doesn’t have the legal capacity to represent themselves, such as children, while ‘Custodianship’ is mainly the duty to take care of children and their daily needs such as education, health and nutrition. Furthermore, Guardianship itself is divided into two different legal status, one is provided by virtue of the law (Welaya) (for the father, paternal grandfather), while the other one is provided through a decision by the Sharia Court to any other person that the Court deems appropriate (Wesaya) (such as the mother or the uncle), and each of them have its own legal provisions that govern them.

These two actions are standalone concepts under the Jordanian Personal Status Law No. 15, Year 2019. However, they also are often required in certain legal procedures to move a case forward or would prevent participants being able to take actions on behalf of other individuals (such as their children) to access basic rights and services like health and education. Guardianship and custodianship procedures will often complicate the nature or duration of a case.

The ICLA programme in Jordan has historically not worked so closely on cases related to guardianship and custodianship but is seeking to better understand procedures and practice regarding these concepts and explore entry points for programming and legal support to refugees of all backgrounds.

NRC seeks a consultant to work with the ICLA Unit to provide Guardianship and Custodianship under the Jordanian Legal Framework Consultation.

Deadline for bid submission is 26.02.2025 - 12:00 PM Amman time.
